2020 Annual Meeting and Election Notice



Dear Homeowner,                                            


The James Creek Homeowners Association, Inc., 2020 Board Election will begin Saturday, October 17, 2020 and end November 6, 2020 at 5:00 pm.

The Annual Meeting will be held on Monday, November 16, 2020 at 7:00 P.M. via RingCentral webinar– virtual meeting.

All Owners are encouraged to attend the Annual Meeting. Please note that no Owner shall be eligible to vote, either online or by written ballot, if that Owner is shown on the books or management accounts of the Association to be more than thirty (30) days delinquent in any payment due to the Association or if the Owner has had his or her voting rights suspended for the infraction of any provision of the Declaration or any other governing document of the Association.


To meet the quorum requirements imposed by the Bylaws for the election of the 2021 Board, Owners entitled to cast their votes for twenty five (25%) percent of the lots (222 homeowners) must have cast their votes either on-line or have delivered a paper ballot to the Association office by November 6, 2020 at 5:00 pm.

Candidate Bio 

Jacob Neal – Biography

Jacob graduated from the Georgia Institute of Technology with a B.S in Computer Engineering.

He has worked for two Atlanta area systems integrators as a project engineer in the automotive, manufacturing, and logistics industries for 7yrs and currently with Mangan Inc. as a senior engineer in the oil & gas industry for 13yrs.

Jacob and his wife, Julia, and their three children have been residents of James Creek since May 2012.  He enjoys reading, gardening, and getting outdoors with the kids.                               

Jacob is committed to performing Board duties and activities in a professional manner per the by-laws and covenants while focused on improving communication with residents, maintenance and landscaping, and enhancement of property value. He has served on the Architecture Review Committee since 2013, several years on the landscaping committee and several efforts on the nature trail and neighborhood watch.


Jayesh Patel – Biography

Jayesh graduated from De Montford University, UK, earning both a Bachelor in Electronic

Engineering and Computer Science.


Over his long career he has worked across all industry verticals and is currently working as an IT

architect for a large IT Services organization.


Jayesh and his wife Harshika, have been residents of James Creek since December 2007. When

he is not working, he enjoys gardening, reading and vacations.


Jayesh was originally appointed to the JC board by James Creek developers in 2011/12 and

subsequently elected and served as president of the JC HOA board from 2012 to 2015. Jayesh is

committed to advancing the common interest of homeowners in the James Creek Community

around good governance, transparency, cost containment and especially enhancement of our

community and property values. He has the right experience, skills, and communications style to

work effectively with elected representatives on the homeowner’s association Board.


Kathleen Diaz – Biography

My family and I have been living in James Creek for over 10 years and have enjoyed

living here & being part of this great community. I currently work in the greater Atlanta

area in Client Services with clientele throughout the US. My goal as a member of the

Board is to best represent James Creek with implementing open & productive

communication serve with honesty and integrity for the betterment of all residents.


For 2021, I would like to improve the quality of services our HOA fees are applied to

without increasing fees. Some of the areas of focus would be:

• Landscaping contractor & OLM

• Improvement in the common areas in the townhome section and

entrances for all of our subdivision sections

• Revisit contracts with both vendors

• Covid-19 planning for 2021

• Reviewing & revising coverage of insurance and pool maintenance

• Planning and preparing of all amenities for 2021 and beyond

• Homeowner maintenance and accountability

• General upkeep of grounds and building structures (single-family homes

and townhomes)

• Pet control including leashing and waste pick-up in all common areas

• Address speeding and traffic sign adherence

• Adherence of the HOA covenants

• Improve communication of covenants to all residents

• Work to increase compliance of the HOA covenants


I will work closely with my fellow board members to improve the community. I will

ensure all funds are used appropriately and for the betterment of James Creek. I look

forward to a productive and positive 2021.


Lawrence H. Davis, Jr. - Biography


I hold a Bachelor of Arts Degree in Criminal Justice and a Masters of Business Administration.


Professional Work Experience:

Currently, serve as an independent Herbalife Distributor.  However, my work experience consist of over twenty-years in the public service arena with extensive knowledge in strategic planning, policy analysis, budgetary & financial management, customer service, project management, event management, municipal law, process improvement and operational management.


My work accomplishments include assessing current and future staffing needs, overseeing allocation of financial resources, and managing budgetary processes.  I have built and lead successful, goal-oriented teams of professional staff while maintaining the budgets and resources for bottom-line results.  I have also turned unprofitable operations into profit-makers.  I have contributed to keeping departments/divisions running like well-oiled machines with a warm, human touch. 


Community Involvement:

I have lived in the James Creek subdivision with my wife, Melissa and two children for about eight years.  Since, such time I have served five years on the Local School Council for Daves Creek Elementary School and three years on the Parent Teacher Organization Board of Directors for South Forsyth Middle School. 


Please explain why you wish to volunteer on the Board of Directors:

As an incumbent Board member, I would like to have the opportunity with your support to continue working for all residents on making our community the ideal subdivision in South Forsyth.  I have always been committed to the practice of good and effective governance, transparency, making educated decisions for the entire community, effectively working with our property managers/management company, and recommending subdivision enhancements.

-This is a lifetime appointment given to only 100 dentists at one time

Mark and his wife Laurie, along with their two children, have lived in James Creek since March 2008.  Laurie’s mother has also lived in James Creek since 2009. 


Sushma Sharma- Biography

My name is Sushma Sharma and I am asking for your support in the James Creek HOA Board Election.

My son, mother, and I have been full time residents of the community for 12 years. We have watched

James Creek grow into the thriving community we have today and are proud to be a part of it.

I have lived in the Northeast Atlanta area for over 30 years. After emigrating from India, I started my

career in customer service from humble beginnings in restaurants, to running my own restaurant. After

selling the successful restaurant, I transitioned into a real estate career where I have learned much

about homeownership, negotiation, public relations, and contractual obligations.


I would be honored to have the opportunity to use my skills and years of experience to serve the James

Creek community. As a Board member, I would work to maintain the safe, family-friendly, and

comfortable neighborhood that past board members have created, while looking for areas for

improvement and growth. I also strongly believe in serving as a good steward of community funds,

finding cost-effective measures to improve our community without sacrificing quality.

Thank you for your consideration of my candidacy for the James Creek Board of Directors. If elected, I

would work tirelessly for you and all the members of our community.


Winston A. DePass – Biography

Winston graduated from Pace University, New York, earning both a Bachelor of Business Administration Degree in Accounting and Information Systems, and a master’s in business administration specializing in Taxation. He is also a Certified Internal Auditor (C.I.A.).

He has worked for several Fortune 500 companies and is currently doing consulting work for a global energy company.


Winston and his wife, Maureen, have been residents of James Creek since August 2007. He enjoys leisurely reading, gardening, and a lively game of cricket.       


Winston is committed to advancing the common interest of homeowners in the James Creek Community around good governance, transparency, cost containment and enhancement of property value. He has the right experience, skills, and communications style to work effectively with elected representatives on the homeowner’s association Board. He previously served on the James Creek Board from 2013 through 2016.


Richard Heenan - Biography


I have a Bachelor of Mechanical Engineering from General Motors Institute (now Kettering University)

and a MBA from the University of Michigan.


Professional Work Experience

Both Adrian and I were born and raised in Michigan. After graduating from the University of Michigan, I

spent three years with General Motors and then I joined Coopers and Lybrand, which in the late 1990s

became PricewaterhouseCoopers (PwC), and spent 32 years in management consulting. Over the 32

years, Adrian, and I have lived in Detroit, New York City, Denver twice, Kansas City and in 1993 we moved to Cumming to get out of winters. In 2003, I retired from PwC and spent the next 8 1/2 years building management consulting business for Black & Veatch Corporation. I then had the opportunity to join Oracle Corporation as a Vice President to run their global Utility Consulting practice. In mid-2013, I found my replacement and since then I have been working part time focused on a few key clients.


Why I Wish to Stand for Re-election to the Board of Directors

Adrian and I have lived in the community for over 11 years and I have served on the James Creek Board

as Treasurer and an at large Board member. Over those years, I have had the opportunity to participate

with my fellow Board members to:


1.            Make significant improvements in landscaping and maintenance of HOA assets.

2.            Put the HOA on a sound financial basis.

3.            With input from representatives of the Townhomes, make significant improvements in their



As the community ages, I would appreciate the opportunity to continue to ensure the HOA remains on

sound financial basis and continues to maintain and improve our infrastructure.


I would also like to be part of a team that restores residence confidence in the Board to address issues

timely and ensure that the by-laws are evenly enforced, and standards are adhered to.


Terri Pagani – Biography

Terri graduated from the University of Minnesota-Carlson School of Business with a Bachelor of Science

degree. Emphasis was in Management, Marketing and Transportation.

She has worked in the Defense Industry with multiple contractors engaged in the production of various

missile and torpedo systems. After spending ten years as a stay at home mom, she re-entered the

workforce in the home construction industry. Currently, Terri is the manager of a small signage company

in Buford.


Terri has lived the James Creek townhome community since April 2015. In her free time, she enjoys the

outdoors, including hiking both internationally and in the US, traveling, reading, and spending time with

her grandson.


Terri has served on the James Creek Board previously, in 2017 and 2018. If elected, Terri would like to

see the board advance the interests of the townhome community with a functioning Townhouse

Committee that can interact with the James Creek board. In addition, she would also like to see the

JCHOA board provide greater transparency, better governance, and enhancement of property values for

the entire community. Lastly, we need to effectively manage our assets, both physical and monetary to

assure that we can provide for the future needs of our community.


Sanjay Tiwari - Biography

In these times of highly polarized country, we need a voice of reason and a catalyst for change in the right direction. Even though our neighborhood and board members are not that polarized as far as improvement to our neighborhood is concerned, we do have different ideas and processes in mind.


I have been that voice of reason and catalyst for change in the current board and I'll continue to work on improving things. Year 2020 has been a crazy year for all of us. We have, however, taken some drastic but encouraging steps to make things better in upcoming years. Next year will be critical to implement these changes successfully and improve things to next order of magnitude.


I'm an IT Project Manager by profession in the Software and Productivity Solution division of Honeywell. I live in Lennar section of our subdivision on Penrith Dr since last 7+ years. I love gardening and building new things in the spare time I get after Family & Friends, Work, and Volunteering. 


I'm honored to serve and represent you on our board for last 3 years and seek your vote again for the next year. As always, I promise to be available to listen to you.
